You understand and agree that physical movement, fitness training, breathwork, and wellness practices—including but not limited to yoga, strength training, cardiovascular exercise, guided assessments, and personal development activities—can be physically, emotionally, and mentally strenuous.Haumbody Sanctuary’s Services and digital content are intended solely for use by healthy adult individuals. These offerings are not designed for minors, pregnant individuals, or those with known health conditions or physical limitations. If you fall into any of these categories, or if you have a medical or psychological condition that could be affected by exercise, breathwork, meditation, or emotional coaching, we strongly urge you to consult with a qualified healthcare provider before engaging with any of our Services—online or in person.By participating in any Haumbody Sanctuary class, workshop, wellness session, event, or coaching program, you acknowledge and accept that:Exercise and wellness practices carry inherent risks, including (but not limited to) physical injury, emotional distress, illness, disability, and in rare cases, death.These risks may arise from your own actions, the actions of others, environmental conditions, or the nature of the activity itself.You voluntarily assume full responsibility for any and all risks associated with your participation in any Haumbody Sanctuary offerings, whether facilitated in-studio, virtually, or through self-guided practices.By using the Site or participating in Haumbody Sanctuary Services, you agree that you are doing so voluntarily and entirely at your own risk, and that Haumbody Sanctuary LLC and its affiliates, instructors, staff, and partners shall not be held liable for any harm or damages arising from your participation.

Haumbody Sanctuary offers content, classes, events, and programming that include elements of wellness, movement, personal development, mindfulness, nervous system regulation, and lifestyle education. The materials, recommendations, and information provided through our Site, studio, assessments, coaching programs, and digital services are intended for general informational and educational purposes only.Nothing we offer constitutes or is intended to substitute for professional medical, psychological, nutritional, or mental health advice, diagnosis, or treatment. We are not licensed healthcare providers, and our staff and instructors do not diagnose conditions or prescribe treatment plans. This may include formal photography, casual candid images, short-form social media content, or promotional filming.In exchange for your participation in Haumbody Sanctuary experiences, you voluntarily consent and grant Haumbody Sanctuary LLC, its team, agents, and promotional partners the perpetual, worldwide, royalty-free right to use, reproduce, publish, distribute, and modify any such photographs, audio, video, or other recordings that may contain your image, likeness, and/or voice, in whole or in part, and in any medium now known or later developed.This includes, but is not limited to:Social media content (e.g., Instagram Reels, TikToks, Stories)Promotional materials (e.g., flyers, ads, website banners)Event recap videosStudio storytelling and marketing campaignsCommunity testimonials or member highlights
You understand that these materials may be edited, cropped, layered with text or music, or combined with other content and that you will not have the right to inspect or approve any such final product.You also agree that Haumbody Sanctuary may use de-identified information gathered from your use of the studio, wellness assessments, or participation in classes or events for purposes including, but not limited to: research, programming improvements, community trend insights, and anonymous statistical analysis—provided such use does not personally identify you.You hereby waive any and all claims related to the use of your image, likeness, or voice, including without limitation claims of libel, invasion of privacy, or violation of publicity rights, and you agree to hold harmless and indemnify Haumbody Sanctuary from and against any such claims.If you prefer not to be photographed or recorded, please notify us at the front desk or by emailing support@haumbodysanctuary.com prior to your visit. While we cannot guarantee full exclusion from all recordings in public or group settings, we will do our best to accommodate reasonable requests.

For ACH payments, you confirm that you are an authorized signer on the linked bank account and grant permission for recurring and one-time debits in accordance with any applicable agreements or service plans.We do not store your full payment credentials on our systems. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

15. Procedure for Making Complaints

To the maximum extent permitted by law, you release Haumbody Sanctuary and all of our affiliated entities, team members, service providers, and partners from any and all liability for claims, demands, losses, damages, and disputes—known or unknown—arising out of or connected to: (i) disputes with other users, (ii) third-party services or content, (iii) unauthorized access to your account, or (iv) any use of your information in accordance with these Terms and our Privacy Policy.If you are a California resident, you waive California Civil Code §1542, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release.”

22. Governing Law

These Terms and any dispute related to them shall be governed by and interpreted in accordance with the laws of the United States and the State of Nevada, without regard to conflict of law principles. The Site shall be deemed to be based solely in Nevada and shall not give rise to personal jurisdiction elsewhere.

23. Alternative Jurisdiction

If the arbitration clause is found to be unenforceable, you consent to the exclusive jurisdiction of the state and federal courts located in Reno, Nevada for any legal action or proceeding related to these Terms. You agree that Reno, Nevada is a proper venue and waive any objections on the grounds of inconvenient forum.

24. Waiver

Failure by Haumbody Sanctuary to enforce any part of these Terms shall not be deemed a waiver of any rights. Any waiver must be in writing to be valid.

25. Severability

If any part of these Terms is found to be unenforceable under applicable law, that part will be replaced by a valid provision that best reflects the original intent, and the remainder of the Terms will remain in full force and effect.

26. Binding Individual Arbitration and Class Action Waiver

This means no class actions, collective actions, or representative proceedings are allowed in arbitration or in court. If, for any reason, a Dispute proceeds in court rather than arbitration, we each waive any right to a jury trial.

Opt-Out Option

You may opt out of this arbitration agreement and class action waiver within 30 days of first agreeing to these Terms by sending a written notice with your name, mailing address, email address, and a clear statement that you wish to opt out of binding arbitration to support@haumbodysanctuary.com or to our studio address listed above.

27. Entire Agreement

These Terms, along with our Privacy Policy and any other policies posted on the Site, constitute the entire agreement between you and Haumbody Sanctuary regarding the Site. These Terms supersede all prior or contemporaneous agreements, proposals, or communications—whether oral or written.

28. FORCE MAJEURE

We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, changes in law, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, pandemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), cyberattacks, denial of service attacks, restraints or delays affecting carriers, inability to obtain or delay in obtaining adequate or suitable supplies, breakdown of materials or telecommunications, or power outage.

29. Electronic Record Keeping

You agree that a printed version of these Terms and any electronic notice shall be admissible in any legal proceeding to the same extent as other business documents maintained in printed form.

30. Miscellaneous

No party to these Terms shall be considered the drafter, and these Terms shall not be interpreted for or against either party. These Terms are assignable by Haumbody Sanctuary and will inure to the benefit of our successors.
